482 VISA Expiring- Here’s what you can do 

The Temporary Skill Shortage Visa (TSS Visa) Subclass 482 or TSS visa is a temporary visa that allows the bearer to live in Australia while working full-time in the selected capacity for the sponsoring employer. TSS visa applicants are permitted to include dependent family members in their application. 

Who is it for?

There are two types of TSS visas: short-term and medium-term. Those on the Short-term Skilled Occupations List (STSOL) are eligible for visas of up to two years (renewable once for another two years). At the same time, those on the Medium and Long-Term Strategic Skills List (MLTSSL) are eligible for visas of up to four years, with permanent residency eligibility after three years.

Qualification for a TSS VISA

Occupation

The position that the company is looking to fill must be listed on the Combined List of Eligible Skilled Occupations. The Department of Home Affairs (previously DIBP) uses the Australian New Zealand Standard Classification of Occupations to determine if the proposed nominated profession accurately reflects the position’s requirements (ANZSCO).

The position description and the TSS visa applicant’s employment and educational history must match the ANZSCO description.

Applicant Qualifications

Home Affairs case officers cross-reference the position description provided in the employer’s nomination application with the visa applicant’s qualifications and work references when assessing a TSS visa applicant’s skills and capabilities against the nominated post. The applicant must possess the necessary abilities to perform the job. Although the required abilities differ depending on the occupation, all TSS visa applicants must have two years of relevant work experience.

Applicants who are not from an exempt nation (the United Kingdom, the United States, Canada, New Zealand, or Ireland) must also complete the English language criteria at the time of application.

Additional Information

Health and character requirements must also be met. Every country in which the applicant has lived for 12 months or more since turning 16 years old in the last ten years requires a police clearance certificate.

When VISA is Expiring

There are legal options if the Australian visa has expired or is about to expire and one wishes to stay in the country. Before reporting to the Department of Home Affairs, it’s wise to consult with an immigration lawyer to go through all visa possibilities.

If the applicant wants to maintain the worker after their visa expires, he must make a fresh nomination and apply for a new visa. They are unable to extend their stay by extending their visa, so that won’t work in this case.
